Beauty treatment burns

Beauty treatment burns are unfortunately very common and a major risk facing anyone undergoing beauty treatment that involves procedures which can cause burning. This includes procedures that use chemicals, wax and lasers.

Burns are particularly likely to occur where the treatment is not undertaken by trained staff who are experienced in carrying out the procedure. Unfortunately the beauty treatment industry is under regulated, with many untrained or under-trained practitioners administering complex procedures without following basic safety protocols, such as the use of patch testing.

Claiming compensation

Where beauty treatment burns are caused by the carelessness or incompetence of the beauty therapist, salon or clinic, then you may be entitled to claim compensation.

Burning can often be relatively minor, with the patient making a full and prompt recovery. However, for a sizeable minority, the effects can be more long lasting and in some cases result in permanent scarring.

The amount of compensation available will depend upon the specific circumstances of your case and the severity of the injuries you suffer. Claims are therefore assessed on a case-by-case basis, with compensation being paid for both the ‘pain and suffering’ of the injury itself, and the financial losses incurred by you as a direct result.

If you suffer permanent scarring then we will consider whether camouflage makeup will be required. If it is then we can claim the costs of this, both now and in the future.

Compensation for facial scarring

Compensation for facial scarring is assessed in terms of severity, with five distinct categories, ranging from ‘trivial’ through to ‘very severe’.

‘Very Severe’ scarring will typically involve young people who suffer major disfigurement, with compensation up to £91,000 being awarded. ‘Less Severe’ scarring, where disfigurement is still substantial, attracts awards in the range of £16,000 to £45,000, with that range decreasing to £8,000 to £28,000 for scarring classed as ‘Significant’, such as scars that are visible at conversational distance. Cases that involve scarring termed as ‘Trivial’, where the effect is minor, will tend to attract compensation within the £1,600 to £3,300 range.

Compensation for non-facial scarring

Awards of between £7,300 and £21,300 are made for scarring involving a number of noticeable laceration scars, or a single disfiguring scar of leg(s), arm(s), hand(s), the back or the chest.

Compensation for a single noticeable scar, or several superficial scars, of leg(s), arm(s) or hand(s), involving minor cosmetic deficit is typically between £2,200 and £7,300.

Psychological injury

Victims of beauty treatment burns can suffer psychological trauma, for which compensation can also be claimed.

Where the condition is termed ‘Moderate’, awards of up to £18,000 are made.

For less severe psychological harm, the range is usually between £1,500 to £5,500.
